摘要：中華人民共和國海事局（原中華人民共和國海上安全監(jiān)督局）是我國海上交通安全監(jiān)督和海洋環(huán)境保護(hù)行政主管機(jī)關(guān)，他的這一職能是法律所賦予的。《中華人民共和國海上交通安全法》賦予海事主管機(jī)關(guān)對交通事故的調(diào)查處理權(quán)力。1984年11月以后，最高人民法院相繼在廣州、上海等地設(shè)立了海事法院，海事法院專門受理海商案件，對海事法院判決和裁定不服的上訴案件，由海事法院所在地高級人民法院管轄。由此產(chǎn)生了對海事行政主管機(jī)關(guān)調(diào)查處理海事權(quán)能的爭議，2000年7月1日后《中華人民共和國海事訴訟特別程序法》的生效，更使這種爭議不斷升級。經(jīng)常看到一些盡陳海事主管機(jī)關(guān)解決因海事而引起的民事糾紛案件的弊端的文章，提出海事主管機(jī)關(guān)調(diào)查、調(diào)解、處理海事的權(quán)能應(yīng)完全由海事法院的司法程序予以替代，本人并不贊成這一觀點(diǎn)，但對海事調(diào)查、調(diào)解、處理現(xiàn)狀作客觀的總結(jié)，進(jìn)一步作一些探討，從而推進(jìn)我們的工作，應(yīng)該是明智之舉，更是“執(zhí)政為民”的具體體現(xiàn)。

本文先對海事行政主管機(jī)關(guān)的行政職權(quán)、工作性質(zhì)作了粗淺的介紹，以使從未接觸過這一專業(yè)性較強(qiáng)的工作的同志對這一工作有所了解。通過圍繞海事行政主管機(jī)關(guān)調(diào)查處理海事的合法性、有效性、便捷性，分析海事行政主管機(jī)關(guān)和海事法院解決海事所引起的民事糾紛案件的利弊，闡述了這一行政職能存在的必要性。同時(shí)還指出了海事行政主管機(jī)關(guān)目前開展這項(xiàng)工作存在的不足，指出其自我完善的緊迫性，并就改進(jìn)和完善海事行政主管機(jī)關(guān)海事調(diào)查處理現(xiàn)狀，提出一些不成熟之個人愚見。

Thistextfirstlysuperficiallyintroducesmaritimeaffairsadministrationsupervisororganization’stherightofadministration,theworkkind,inordertothepeoplesthatnevercontactthespecialworktounderstandthework.Fromthelegitimacy,usefulness,convenientofmaritimeaffairsadministrationsupervisororganization’sinvestigationandhandlemaritimeaffair,analyzethegainsandlossesofmaritimeaffairsadministrationsupervisororganizationandmaritimecourthandlethecivilcasedisputefrommaritimeaffair,describlethenecessityofmaritimeaffairsadministrationsupervisororganizationworkingtalentexsitting.Inthesame,thetextpointsoutthelackofmaritimeaffairsadministrationsupervisororganizationdoingtheworkandtheurgentofmyselfperfect,andIbringupsomenotmaturepersonalhumbleopinionabouthowimprovementandmyselfperfectthepresentconditionofmaritimeaffairsadministrationsupervisororganization’sinvestigationandhandleofmaritimeaffairs.
